Terms of Service
Last updated 2 October 2026
1. Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and Andever Collective LLC, an Arizona limited liability company doing business as Day Rhythms ("Day Rhythms", "we", "us"), which operates the service, covering your use of the Day Rhythms app and website. By creating an account or using the service you accept these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. The service
Day Rhythms is a personal planning tool: you keep task lists, schedule them as time blocks on a calendar, optionally connect external calendars and task tools, and use automated planning features such as "Plan my day" to arrange your schedule. We may add, change or remove features over time; we will not materially degrade a paid feature during a period you have already paid for without offering a full refund of the unused portion.
3. Eligibility and your account
You must be at least 16 years old and able to form a binding contract where you live. You are responsible for keeping your credentials secure and for all activity under your account, and you agree to tell us promptly if you suspect unauthorised access. One person per account; do not share logins. We may refuse, suspend or terminate accounts that violate these Terms.
4. Your content
Your tasks, schedules, notes, attachments and anything synced in from a connected service remain yours. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, transmit and display that content solely to operate the service for you and to send it to the third parties you explicitly connect (for example, writing a block to your Google Calendar when you enable push sync). This licence ends when you delete the content or your account, except for backups that roll off on the schedule in the Privacy Policy.
You are responsible for your content and confirm you have the rights to upload it and that it is lawful.
5. Plans, trials and payment
The free Dawn plan includes tasks, lists, habits and routines, time-blocking, exports and sharing, one Plan my day run per day (resetting at your local midnight), one connected calendar account, two schedule imports in total and 100 MB of attachments. Daylight is a paid subscription, billed monthly or yearly, that adds unlimited Plan my day, automatic deadline scheduling, unlimited connected calendar accounts and schedule imports, the weekly rhythm review and 2 GB of attachments. Current prices are shown on the pricing page and in Settings → Plan & billing at the time you buy.
Free trial. New accounts receive 14 days of Daylight automatically. No payment method is required and nothing is charged. When the trial ends the account moves to Dawn: your content is kept, blocks already on your calendar stay where they are, your first connected calendar account keeps syncing, and any additional calendar accounts are paused (not deleted) until you subscribe. One trial per person.
Student plan. The Student plan includes the same features as Daylight and is billed yearly. It is available only to people who verify an email address on a recognised academic domain (such as .edu, .ac.uk or .edu.au) that they currently control. We may ask you to verify again at each yearly renewal, and if you can no longer verify eligibility we may move you to Daylight pricing or Dawn from your next renewal.
Founding member. The Founding member offer is a single one-time payment for Daylight features for the lifetime of the product, limited to the first 250 purchases. "Lifetime" means for as long as we operate and offer Day Rhythms as a service, not the lifetime of the purchaser. You will not be billed again for it. If you held a subscription when buying, it is cancelled automatically.
Subscriptions renew automatically each period until cancelled. Payments are handled by our reseller Paddle.com, the Merchant of Record for all orders; we never receive or store your full card details. Prices exclude taxes unless stated. We may change prices with at least 30 days' notice before the change applies to your next renewal; this never affects a completed Founding member purchase.
6. Cancellation and refunds
If you're not happy, email support@dayrhythms.com within 14 days of any payment and we'll refund it in full. This includes the one-time Founding member purchase. Refunds are processed by our reseller Paddle and go back to the original payment method. You can also request one through paddle.net.
After 14 days, you can cancel anytime from Settings → Plan & billing and keep access until the end of the period you paid for. Your account then moves to the free Dawn plan and your tasks and lists stay. Nothing in these Terms limits any refund right you have under the law where you live. Our full refund policy is at dayrhythms.com/refunds.
7. Automated planning and AI features
"Plan my day" and automatic scheduling create, move and remove time blocks on your behalf based on your tasks, deadlines and preferences. They run inside Day Rhythms and can still be wrong or incomplete, so review anything that matters and keep your own record of critical commitments. Schedule import uses a third-party AI model to read the file or text you choose to upload; only that content is sent to the model provider, and its output is shown to you for review before anything is added. AI output can be inaccurate and is not professional advice.
8. Connected services
Connecting Google, Microsoft Outlook, Apple/CalDAV, Notion, Todoist or Asana authorises us to read and, if you enable push sync, write data in those accounts on your behalf. Those services are operated by third parties under their own terms and privacy policies, and we are not responsible for their availability, accuracy or actions. Your use of Google APIs is also subject to the Google API Services User Data Policy. You can disconnect any integration at any time from Settings → Calendars & sync, which deletes the stored credentials.
9. Acceptable use
You agree not to: break, overload, probe or reverse-engineer the service; access another user's data; circumvent usage limits, billing or access controls; resell or sublicense access; upload malware or unlawful content; scrape the service by automated means; or use it to violate any law or third-party right. We may suspend or terminate accounts that do.
10. Intellectual property and feedback
The service, including its software, design, branding and content (other than your content), is owned by us and protected by intellectual property laws. We grant you a limited, revocable, non-transferable licence to use it for your own planning while your account is in good standing. If you send us feedback or suggestions, we may use them freely without obligation to you.
11. Termination
You can delete your account at any time from Settings → Data & account. This permanently removes your tasks, lists, sessions, attachments and integration connections and cancels any active subscription; it cannot be undone, so export your data first. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. In the last case we will give reasonable notice and refund any prepaid, unused period in full. Sections that by their nature should survive termination (content licence wind-down, disclaimers, liability, governing law) survive.
12. Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free or that scheduling output will be accurate, and we are not responsible for data held in third-party services you connect. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you, and nothing here limits rights you have as a consumer that cannot be waived.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or missed appointments or deadlines. Our total aggregate liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim and USD 50. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.
14. Indemnity
You agree to indemnify and hold us harmless from claims, damages and reasonable costs arising out of your content, your use of the service, or your breach of these Terms or of applicable law.
15. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules, and the state and federal courts located in Maricopa County, Arizona have exclusive jurisdiction. If you are a consumer resident in the EEA or UK, this does not deprive you of the protection of the mandatory laws of your country of residence or of your right to bring proceedings in your local courts. Before filing a claim, please contact us so we can try to resolve it informally.
16. General
These Terms and the Privacy Policy are the entire agreement between us regarding the service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger or sale of assets.
17. Changes and contact
We may update these Terms. The "last updated" date above reflects the current version, and we will give notice in the app or by email before material changes take effect. Continued use after that date means you accept the updated Terms. Questions can be sent to support@dayrhythms.com.
